PLEASE READ CAREFULLY.

This agreement releases Fit Barre Inc. (“Fit Barre”) and anyone acting for or on its behalf from all liability relating to any injuries, illness, loss of life or property damage sustained during Fit Barre classes. By acknowledging and submitting this agreement, I, a Participant, for myself, my heirs, executors, administrators, or any others who may claim on my behalf, agree to hold Fit Barre and anyone acting for or on its behalf entirely free from any liability, including financial responsibility, for injury, illness, loss of life or property damage incurred, and agree not to sue Fit Barre and anyone acting for or on its behalf with respect to any cause of action for bodily injury, illness, loss of life or property damage sustained by this Participant as a result of participating in the exercise program offered by Fit Barre. Illness shall include, but is not limited to, any contraction of COVID-19 arising from participating in the exercise program offered by Fit Barre.

Participant hereby assumes full responsibility of the risks involved in a Fit Barre fitness class. These include but are not limited to bodily injury (including death) or illness or property damage due to the negligence of Fit Barre and/or any third party including other persons participating in the exercise program.

All personal property brought by Participant to the Fit Barre Studio is done at the sole risk of the participant with respect to its theft, damage, or loss by Fit Barre or any third party.

Participant agrees that the terms of release contained herein are intended to be as broad and inclusive as permitted by the laws of the Province of Ontario. Any provision found to be invalid or unenforceable by a court shall not affect the validity or enforceability of any other provision.

By signing this waiver, Participant certifies that Participant is at least 18 years of age, and has read, understands, and voluntarily signs this release and agreement. Participant acknowledges that by signing this document he/she is waiving certain legal rights, including the right to sue, and is fully aware of the legal consequences of signing this release.
